Ryan F. Kaiser Wins Appeal On Behalf of Jackson County Juvenile Office
On August 29, 2017, the Missouri Court of Appeals, Western District issued its decision affirming the Jackson County Family Court's judgment terminating the parental rights of a mother incarcerated for the death of the child's sibling. In its decision, the Western District determined the following:
1. When considering the termination of parental rights, a Juvenile Court may take judicial notice of its file, and rely upon the findings, from the underlying jurisdictional proceeding regarding the same child.
2. Evidence of a Mother's actions that resulted in the death of her child, combined with evidence regarding the mother’s insufficient parenting both before and after the events of that child's death, were sufficient to support the trial court’s decision to terminate her parental rights based on §211.447.5(2)(d) RSMo.
